Terms and Conditions

The following general terms and conditions serve as orientation between the customer and Goschler & Partner Inmobiliaria S.L.

A.Obligations of Goschler & Partner Inmobiliaria S.L.

1.Goschler & Partner Inmobiliaria S.L acts exclusively as an agent for real estate transactions.
2. Goschler & Partner Inmobiliaria S.L undertakes to examine all submitted contractual documents according to the means at its disposal.
3. Goschler & Partner Inmobiliaria S.L undertakes to treat all customer data confidentially and not to pass it on to third parties without consent.
4. Goschler & Partner Inmobiliaria S.L undertakes to carry out advertising measures to market the property.
5. Goschler & Partner Inmobiliaria S.L may act for both the seller and the buyer.

B. Owner's information

All information presented regarding a property for sale comes from the seller or an agent authorized by the seller.
Goschler & Partner Inmobiliaria S.L acts as an intermediary in all sales transactions and is dependent on the accuracy of the information provided by the owner.
Goschler & Partner Inmobiliaria S.L only checks the information received within the scope of the options available to it. Goschler & Partner Inmobiliaria S.L assumes
no liability for the accuracy of this information received. Any related claims for damages against Goschler & Partner Inmobiliaria S.L are excluded.

C. Obligations of the owner of a property

1. The owner grants Goschler & Partner Inmobiliaria S.L power of attorney to view all relevant information required for the sale.
2. If there are already ongoing sales negotiations, Goschler & Partner Inmobiliaria S.L will be informed immediately in order to successfully complete the process, provided Goschler & Partner Inmobiliaria S.L can prove that the
customer relationship was established by Goschler & Partner Inmobiliaria S.L. All information about prospective buyers provided by Goschler & Partner Inmobiliaria S.L is exclusively for informational use by the owner.
Passing it on to third parties in order to conclude a contract through them is also prohibited.
3. Goschler & Partner Inmobiliaria S.L is entitled to the agreed sales commission in accordance with the brokerage agreement, provided proof of the opportunity to complete the sale of the property can be provided.
The due date for the remuneration by the owner becomes legally binding after the private/or notarial sales order has been signed. All commission claims are recorded in the sales order and are legally valid for both private individuals and entrepreneurs.

D. Reimbursement of expenses

For extraordinary costs that are necessary to promote the sale, the broker has the right to reimbursement of the costs incurred after consultation with the owner.

E. Additional

1. All agreements not recorded in the sales order must be made in writing and require the written consent of Goschler & Partner Inmobiliaria S.L.
2. The place of jurisdiction is the broker's registered office.

F. Severability clause

Should a provision of these General Terms and Conditions be ineffective or unenforceable or become ineffective or unenforceable in the future, the remaining provisions of the General Terms and Conditions will not be affected.
Instead of the ineffective or unenforceable regulation, the parties undertake now to agree on an effective regulation that comes as close as possible legally and economically to the meaning and purpose of the ineffective or unenforceable regulation.

G. data protection

Personal data is maintained in the brokerage software of Goschler & Partner Inmobiliaria S.L and used for the following tasks: customer management, accounting, administration, advertising and market research.
